THESE TERMS AND CONDITIONS ARE EFFECTIVE FROM 01 JULY 2021 (UPDATED SINCE 24 AUGUST 2021)
BOOKING FEE & PAYMENTS:
A non-refundable 50% deposit booking fee is required at the time of booking in order to reserve and secure the appointment.
No date will be booked and/or secured unless the 50% booking fee, as is referred to above, has been paid in full.
Balance of payment – payable on the day of the photo-shoot. No images will be released until the final balance is paid in full.
Please note that all the charges levied by PayPal must be included along with the booking fee if the payment is done through PayPal.”
TERMS OF DELIVERY:
We do not provide the whole original photos, only the edited ones.Normal Delivery: We deliver your photos within a maximum duration of two months.
Fast Delivery: It takes 2 weeks time to deliver your photos including the additional extra cost of
CANCELLATION:
The deposit of 50% of the total amount paid is not refundable in the case of another lockdown or in any pandemic situation
If Focus Photography has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), 50% of down payment is refundable to the client.
If the client cancel the booking for any unconditional reasons, payment is refundable 30 days prior to the reserved slot, which means, the refund prior to the cancellation shall be done within two(2) month respectively.
POSTPONEMENT & COVID - 19 RESTRICTIONS
Should the Client need to postpone their wedding to a later date, the Client should liaise with the Photographer about the potential new date/s to check their availability before booking a final date with the venue to avoid losing the Photographer. If the Photographer is unavailable on the new date, the retainer fee will not be refunded and the Photographer will find an associate to photograph the event on their behalf. The photographer will then edit the associate photographer images in their own editing style and deliver the images themselves. Postponements made NOT in conjunction with COVID-19 will incur a postponement fee of $150.
FOOD AND REFRESHMENTS
Where the Photographer/s will work 10+ hours during the working day (travel time, on-site attendance etc), carrying heavy camera equipment and walking on average 6-8 miles during the day the Client agrees to pay for the Photographer/s to have a hot meal during the day. Provision must be made with your venue or caterers to provide the photographer/s with a hot meal as soon as possible during the wedding breakfast (this is not usually taken with your guests as the photographer has other important duties to perform during this period and usually takes this time to rest). Where coverage includes up to mid-evening then a second light meal should be available. Where coverage has been agreed to include a second photographer then the same conditions apply to this individual. Where provision is not made the photographer reserves the right to take appropriate rest, food and drink breaks as when required throughout the day. Please note this may impact your wedding photography coverage.
Please be aware this does not apply if the Client has booked the Photographer/s for less than 6 hours using the hourly rate system.
DISPLAY & MODEL RELEASE:
The Client hereby assigns the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The Client releases all claim to profits that may arise from use of images.
LICENSE, COVERAGE AND REPRODUCTION:
Photographs taken during the course of the session/event will be at the diplomacy of the photographer although every effort will be made to comply with the client’s requirements.
The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct.
When attending events the photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.
At certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the event may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
On location of events due to a variety of uncontrolled lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.
Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
PERMITS:
The CLIENT is responsible for acquiring all permits and necessary permission for all locations on which the COMPANY will be performing services.
CREATIVE NOTICE:
Focus Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. Focus Photography’s judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. Focus Photography will do its best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
SAFETY:
The COMPANY reserves to right to terminate coverage and leave the location of the EVENT(S) if the photographer from the COMPANY experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the EVENT(S); or in the event that the safety of the photographer from Focus Photography is in question.
PERSONAL ACCIDENT:
Any directions issued to clients, their guests or employees during a photographic shoot/event are deemed to be at the person’s own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
